1. Licensing Terms for Mockups

1.1. License Types

Focal Suite Marketplace offers the following licensing options for mockups:

  1. Single-Use License:

  2. Permits one-time use for a single project or campaign by the purchaser.

  3. Ownership remains with the Designer, and redistribution is prohibited.

  4. Extended License:

  5. Allows unlimited use within the purchaser’s account for multiple projects.

  6. Ownership remains with the Designer, but the license grants broader usage rights.

  7. Exclusive License:

  8. Grants full ownership to the purchaser, transferring all intellectual property rights.

  9. Designer waives further claims to the mockup and cannot resell or reuse it.

1.2. License Compliance

  1. Purchasers must adhere to the specific terms of the license they acquire.

  2. Any unauthorized use, redistribution, or modification of mockups outside the license terms is prohibited and may result in legal action.

1.3. License Management

  1. All licensing agreements are tracked within the platform for transparency.

  2. Users can view the terms and expiration (if applicable) of their purchased licenses in their account dashboard.

2. Copyright and Trademark Protection2.1. Copyright Protection for Designs and Mockups

  1. All designs and mockups uploaded to Focal Suite remain the intellectual property of the original creator (Designer) unless an Exclusive License is purchased.

  2. Unauthorized use, reproduction, or distribution of any designs or mockups is strictly prohibited.

2.2. Trademark Protection for Branding

  1. Focal Suite branding, including logos, slogans, and trademarks, is protected under Malaysian intellectual property laws.

  2. Users may not use Focal Suite’s trademarks without prior written consent.

2.3. Infringement Reporting

  1. Users may report suspected copyright or trademark infringements via legal@focalsuite.com.

  2. Focal Suite will investigate all claims and take appropriate action, including content removal and account suspension for verified violations.

3. User-Generated Content Policy3.1. Uploading Content

  1. Users uploading content (e.g., mockups, designs, or assets) must:

  2. Ensure the content is original or properly licensed.

  3. Avoid infringing on third-party copyrights, trademarks, or intellectual property.

3.2. Licensing and Monetization

  1. Designers grant Focal Suite a non-exclusive license to display, distribute, and promote their content within the platform.

  2. Monetization of user-generated content (e.g., mockup sales) is subject to platform processing fees as outlined in the Designer’s membership plan.

3.3. Content Ownership and Removal

  1. Designers retain ownership of their uploaded content unless an Exclusive License is sold.

  2. Users may request the removal of their content from the platform at any time, provided it is not tied to active licenses or transactions.

4. Enforcement and Dispute Resolution4.1. Violation Consequences

  1. Violations of intellectual property policies may result in:

  2. Content removal.

  3. Suspension or termination of user accounts.

  4. Legal action where necessary.

4.2. Dispute Resolution

  1. Focal Suite encourages amicable resolution of disputes through its internal resolution tools.

  2. For unresolved disputes, parties agree to binding arbitration under Malaysian law.

5. Updates to Policy

Focal Suite reserves the right to update this Intellectual Property Protection Policy. Users will be notified of significant changes via email or platform announcements.
